These terms apply to all services provided by Ward Jansen Photography ("the Photographer"). By booking a session, the Client acknowledges and agrees to the following:
1. Booking Agreement
1.1 A booking is confirmed once a session date has been agreed upon and the required booking fee (retainer) or full payment has been received.
1.2 The booking fee is non-refundable, but may be transferred once to a new date in accordance with the rescheduling policy (see section 10).

2. Use of Images (Publication)
2.1 Images created by the Photographer may be used for portfolio and promotional purposes, including but not limited to social media, website, magazines, printed materials, and exhibitions.
2.2 If the Client wishes to restrict or limit publication (for example for privacy reasons or in the case of minors), this must be communicated in writing before the session. Any limitations may affect pricing and must be agreed upon in advance.

3. Pricing & Payment
3.1 All prices on the website are subject to change. The agreed price at the time of booking remains valid for that booking, regardless of future price updates.
3.2 Unless otherwise agreed, full payment is due before final delivery of any images. Galleries and downloads will be released only after the balance is paid in full.
3.3 Additional services (extended retouching, extra images, prints, licenses, travel fees, etc.) will be invoiced separately according to the current price list.

4. Image Delivery & Format
4.1 Edited images are delivered in JPEG format only via an online gallery. RAW files are not provided.
4.2 Standard delivery time is up to 4 weeks after the session, unless otherwise agreed in writing.
4.3 The online gallery remains at least available for 2 months after delivery. After that period, archived files may be re-activated upon request, subject to a €200 reactivation fee, if recovery is technically possible.
4.4 The Photographer is not obliged to store files beyond this period and cannot guarantee long-term archiving.

5. Colour and Editing
5.1 Final images may appear differently depending on device or screen calibration. The Photographer is not responsible for colour discrepancies in third-party prints or displays.
5.2 Clients may not apply additional filters or edits to the delivered images unless agreed in writing.
5.3 Standard editing includes basic exposure, colour corrections and minor retouching. Extensive retouching (e.g. body reshaping, object removal, complex skin work) is available at an additional fee and must be agreed in advance.

6. Authorship & Copyright
6.1 All images remain the intellectual property and copyright of Ward Jansen Photography.
6.2 Private clients receive a non-exclusive license for personal use only (e.g. personal prints, social media posts with credit, personal profile pictures), unless otherwise agreed in writing.
6.3 Any commercial use (marketing, advertising, publications, billboards, product packaging, etc.) must be explicitly agreed upon in a separate written agreement and license. Unauthorized commercial use will result in additional invoicing and may lead to legal action.
6.4 For business clients (B2B), social media usage, website, business cards, and small-scale printed materials are included unless otherwise stated in the offer. Any extended usage (e.g., editorial publications, national campaigns, large-scale outdoor ads) requires prior written approval and a separate licensing agreement.

For unpaid collaborations (Time For Print, creative concepts, or portfolio-building sessions):
7.1 The Photographer retains full authorship and copyright of the images.
7.2 The Photographer decides which images are edited and delivered. No minimum number or delivery deadline is guaranteed unless agreed upon in writing.
7.3 Unless otherwise agreed in advance, the number of edited images delivered is limited to the standard portfolio package as listed on the Photographer’s website (https://wardjansenphoto.com/profile-shoots). Additional images may be purchased at the Photographer’s stated fee.
7.4 All parties agree that the resulting content is for non-commercial use only (personal portfolio, social media with credit, agency use, etc.).
7.5 Any commercial use or monetization by any party (including model, designer, makeup artist, brand, etc.) must be explicitly agreed upon in writing and may require a separate licensing fee.
7.6 Editing or altering the images is not permitted without written permission from the Photographer.
7.7 Proper credit must always be given when images are published, e.g. “Photography by Ward Jansen” (and tagged where possible).

9. Cancellations & No-Show Policy
9.1 Cancellations more than 7 days before the shoot are free of charge (except the non-refundable booking fee, if applicable).
9.2 Cancellations between 7 days and 48 hours before the shoot will incur a fee of 30% of the total session cost.
9.3 If the Client cancels within 48 hours before the shoot and does not reschedule, the full session fee is due.
9.4 If the Client fails to attend the shoot without notice (no-show), the full session fee is due and no refund will be issued.

10. Rescheduling
10.1 Clients may reschedule their session once without penalty, provided the new date takes place within 3 months of the original booking date.

10.3 Rescheduling requested within 48 hours before the session may be treated as a cancellation at the Photographer’s discretion (see section 9).

11. Liability
11.1 The Photographer is not liable for injuries, property loss, or damage incurred before, during, or after the session. Participation in the session is at the Client’s own risk.
11.2 In the event of severe weather, technical failure, illness, or other personal emergencies, the Photographer reserves the right to reschedule by mutual agreement.
11.3 If the Photographer is unable to deliver the session or images due to unforeseen circumstances and no alternative can be offered, any fees already paid (excluding delivered services) will be refunded. No further compensation or damages will be issued.
11.4 The Photographer is not responsible for delays or errors caused by third-party services (print labs, hosting providers, delivery services, etc.) or for indirect or consequential damages (such as loss of revenue or opportunities).

12. AI Use & Machine Learning
12.1 The Client may not upload, submit, train, or otherwise use the delivered images for the development, training, or refinement of artificial intelligence or machine learning systems, including but not limited to generative image models.
12.2 Any use of the images in AI-based tools or for AI-generated derivatives requires prior written consent from the Photographer and may be subject to separate licensing fees.

13. Complaints and Edits
13.1 Requests for minor adjustments or feedback must be submitted within 14 days of image delivery. After this period, edits are no longer guaranteed and may be subject to an additional fee.
13.2 If the Client has a complaint, they must raise it in writing within the same 14-day period, describing the issue as clearly as possible so the Photographer can respond and, where reasonable, offer a solution.

14. Final Notes
14.1 The Photographer reserves the right to decline a session or collaboration if it does not align with their values, safety, or creative direction.
14.2 These Terms and Conditions may be updated from time to time. The version in force at the time of booking applies to that booking.
